The Touchuman Inc Terms of Service

We are ToucHuman Inc (the "ToucHuman," "us," "we" or "our"), the company that maintains the ToucHuman websites (including but not limited to touchuman.com) and related sites, media or mobile applications (collectively, the "Service"). As a user of the Service ("you" or "your"), you agree to be bound by these Terms of Use ("Terms") as well as the Privacy Policy ("Privacy Policy"). Your rights, obligations, and restrictions regarding the Service are outlined in these Terms. Please read them carefully. The Service should be discontinued if you do not agree to the Terms and all applicable laws.

However, we cannot guarantee that product or service descriptions or other Stuff on this Service is accurate, complete, reliable, current, or error-free. If you are dissatisfied with the Service, these Terms, or the Privacy Policy, your only remedy is to cease using the Service.

Your personal Information

Any personal information you provide must be accurate and up-to-date. We may verify the accuracy of your information at any time. Passwords should be created securely and protected from unauthorized access. We expect you to notify us immediately if your user identification, password, or other identifying information has been lost, stolen, or otherwise compromised. You will be held responsible for any activity under your user identification. You also agree to be responsible for any losses or claims resulting from someone else using this service or accessing your user name, password, or other identifying information. Anyone who uses this service after you have notified us that their username, password, or other identifying information has been lost, stolen, or compromised is subject to this policy.

Contributing Staff

By contributing Stuff to our Service, you agree to the following terms:

• Impersonation, abuse, harassment, threats, or intimidation of other people is not permitted on the Service.
• The Service will display your Stuff publicly.
• Third party search engines, such as Google, may index your Stuff, including your public account information, such as your display name, and may not remove it immediately (or ever).

A pledge and representation is made that: (i) you own or otherwise have the right to use Your Stuff; (ii) you have permission to use the names, likenesses, and other personal or identifying information of each identifiable individual; (iii) you have the right to grant all of the rights outlined in these Terms; and (iv) You agree that your use of Your Stuff in accordance with these Terms won't violate any contract, intellectual property, privacy, or other rights.
You may be liable if you submit Stuff for such use without the right.
• You are solely responsible and liable for Your Stuff and conduct on the Service. In accordance with these Terms, we are not liable for any use of your Stuff by us. Any Stuff you submit is subject to the rights, powers, and authority granted herein.
• It may be necessary to modify or adapt your stuff to meet the design and technical requirements of the Service or for any other reason. Your Stuff must be kept in its original form.

It's always your stuff. You still own all copyrights and other rights to Your Stuff. If you upload, post, contribute, or otherwise provide us with Your Stuff, you grant us the right to use, alter, reproduce, distribute, prepare derivative works of, display, perform, and otherwise fully exploit Your Stuff in connection with the Service and our (and our successors' and assigns') business. This license is non-exclusive, perpetual, irrevocable, royalty-free, fully paid, sublicensable, and transferable. Advertising and redistributing any portion of the Services (and derivative works thereof) through any media formats or media channels (including, without limitation, third party services) are examples of this.

The foregoing license grant does not affect your other ownership or license rights in Your Stuff, including the right to grant additional licenses to the material in Your Stuff, unless otherwise agreed in writing. Third parties to whom we sublicense Your Stuff will be encouraged to attribute you, in addition to us, but this may not always be possible.

Removal Of Your Stuff

We will use commercially reasonable efforts to remove any public account information about you after you unregister with us by emailing hello@ToucHuman.com. When you disable your account, Your Stuff becomes anonymous, but it is not automatically removed. You may not be able to remove or edit Your Stuff once you've contributed it to ToucHuman, and we cannot guarantee that it will be completely removed. Because other ToucHuman users may have acted on Your Stuff, you may not be able to do so.

In addition to monitoring and reviewing your account, Your Stuff, and your activity, we may remove or disable your account or Stuff for any reason, including, but not limited to, violations of the Terms, alleged infringements, or verbal, physical, written abuse of another user, employee, member or officer. Before removing your account or your Stuff, we will try to reach out to you via your registered email address, but are not obligated to do so.

We cannot guarantee that your account or Your Stuff will be accessible. In the event that a business or individual holds a legal claim or trademark on a username created by a user, we reserve the right to reclaim the username. A username that has been inactive for more than 6 months may also be reclaimed, and your account may be permanently disabled if it is inactive for an extended period of time.

Guidelines, Fees, Rights and Remedies

Permitted Use of the Service

Whether registered or unregistered, users may visit the websites and use the AndroidTM or Apple iOSTM mobile applications. Unless we have expressly consented in writing, users are not allowed to modify the Service.

Our Service is free to use. To improve our Service, we are happy to accept tips or donations. Payments are processed by a third-party payment processor, and we cannot be held liable for their performance or software.

Fees charged by your internet service provider or mobile carrier for using the Service, including data transfer fees, are your responsibility.

If you wish to conduct legitimate business on the Service, you should not use or attempt to use this Service for any other purpose than viewing or posting customer service information; you may not (and may not allow any third party to) use or attempt to use this Service, upload, download, post, submit, or otherwise distribute content on or through it for any purpose:

• Infringes on the rights of third parties;
• In our opinion, is unlawful, harmful, or otherwise objectionable or inappropriate;
• Unauthorized or unsolicited advertisements, solicitations, schemes, spam, flooding, or other unsolicited bulk emails or unsolicited commercial communications,
• A computer code, file, program, or virus that transmits harmful or disabling information,
• That harvests our e-mail addresses or personally identifiable information,
• Interferes with our network services, the Service's performance, or activities conducted on the Service,
• Using software or other processes to "crawl", "spider", index, or in any non-transitory manner store or cache information obtained from the Service,
• Bypassing measures we may use to prevent or restrict access to the Service (or other accounts, computer systems or networks connected to the Service), the user attempts to gain unauthorized access to our Service.
• Impersonates any person or entity, including an employee or representative of us, or suggests an affiliation with us (without our explicit written permission).
• Our ability to operate this Service or the ability of others to access and use this Service is impaired or limited.

In our sole discretion and without notice to you, we may deny you access to and use of this Service at any time and for any reason.

Intellectual Property Rights

Our Service is owned and controlled by us. Unless it is in the public domain, you may not reproduce, duplicate, copy, sell, resell, visit, or otherwise exploit the Service for any commercial purpose without our express written consent. Without our express written consent, you may not:

We or our content/software suppliers own all content on this Service, including text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software. All content on this site is our exclusive property, protected by U.S. and international copyright laws. The software used on this site is owned by us or our software suppliers and is protected by United States and international copyright laws.

ToucHuman and any respective logos, emblems, slogans and designs appearing on this Service are our trademarks. This Service may contain other trademarks that are owned by their respective owners.
